As the winter transfer window approaches, numerous clubs in the Premier League face the possibility of losing players without compensation, as they navigate the final stretch of their contracts. Since January 1, players with contracts expiring this summer have had the opportunity to engage in discussions with overseas teams about potential transfers.

Players Open to Pre-Contract Discussions

Casemiro

The Brazilian midfielder is set to part ways with Manchester United when his contract concludes at the season’s end. Casemiro, who made the switch from Real Madrid in 2022 for £70 million, has featured in 146 matches. United decided against activating the option for an extra year for the five-time Champions League champion.

Harry Wilson

Negotiations for a new contract between Wilson and Fulham are on hold amid increasing interest from other Premier League clubs for the Welsh forward. The 28-year-old’s contract ends this season, and Fulham has thus far been unable to finalize terms for an extension. It’s believed that Wilson wants to first assess the future of his manager, Marco Silva, who is also nearing the end of his contract.

Ibrahima Konate

The Liverpool defender’s future is uncertain as his contract runs out this summer. He was previously linked with a move to Real Madrid. Konate has been a regular starter in recent matches alongside Virgil van Dijk. Notably, fellow defender Andy Robertson’s contract also concludes in June, with Tottenham expressing interest in bringing the Scottish captain in.

John Stones

An England international playing for Manchester City, Stones is contracted until June but has started only seven Premier League matches this season. City’s manager Pep Guardiola has bolstered the backline by signing Marc Guehi, and Stones, who is 31, faces competition from other defenders including Ruben Dias and Josko Gvardiol.

Marcos Senesi

Bournemouth defender Senesi has turned down several contract proposals and is expected to depart in the summer. Bernardo Silva

The Manchester City captain has indicated he knows what he wants to do once his contract expires, yet he has not disclosed his plans. The 31-year-old, presently in his ninth season at City, was previously connected with potential transfers to Juventus and Benfica.

Understanding Pre-Contract Agreements

Under FIFA regulations, players can initiate discussions with other clubs once their contract is nearing its end or has already expired. These negotiations can begin up to six months before a contract ends, but this rule specifically applies to international transfers.

For instance, a Premier League club can discuss potential pre-contract terms with a Spanish player in January, setting the stage for a summer transfer. Last season, Trent Alexander-Arnold had talks with Real Madrid in the last half-year of his contract before finalizing a transfer to the Spanish giants.

However, the timeline differs for domestic transfers, allowing an English club to discuss terms only within the last month leading up to the contract’s conclusion.

The Bosman Rule Explained

The Bosman ruling, established in 1995, defines the regulations surrounding free agent transfers. This decision allows players to switch clubs without any transfer fees once their contract is completed. The case stemmed from former Belgian player Jean-Marc Bosman’s struggle to join Dunkerque after leaving Liege, leading to a five-year legal battle that fundamentally changed player mobility in football.

Now, with the UK’s departure from the EU, movement regulations for players have subtly shifted, necessitating work permits for those from the EU wanting to join clubs in the UK.

What Is a Transfer Tribunal?

If a player under the age of 24 opts to leave a club on a free transfer or pre-contract, compensation can be claimed by their former team from the new club. This system, administered by the Professional Football Compensation Committee (PFCC), safeguards the interests of clubs that have invested in training young players.

Should there be a disagreement over compensation, cases can be referred to a tribunal, where factors such as a player’s age, duration at the previous club, and potential talent are considered to determine an appropriate payment.

For instance, Liverpool was mandated to pay £6.5 million, plus additional fees, to sign striker Danny Ings after a tribunal decision in 2016.
